3.  When do you collect my data?

Guru Jobs will collect some information directly when the user accesses and browses the Site (IP address and browsing data) based on the settings indicated by the user themselves for tracking tools (i.e., “cookies”: for more details, access the specific section available on the Site).

Additionally, depending on the services and features that the user utilizes, personal data may also be processed when the user:

-  requests assistance on our services and products;

-  registers and accesses their personal account on the Site;

-  uses the services and features of the Site;

-  registers or participates in a Guru event;

-  requests to try or purchases services or products;

-  applies to work with us;

-  subscribes to our newsletter;

-  downloads materials made available on the Site.

 

4.  What data will you process?

a) Browsing data  

When you browse the Site, some personal data, defined as "Browsing data", may be processed. These are personal data whose transmission is implicit in the navigation of websites, including but not limited to data traffic and data concerning localization, the weblog, and other communication data for possible billing purposes or concerning the resources you access through your device. These are acquired by computer systems that enable the proper functioning and ensure the security of the Site. Although these pieces of information are not collected to be associated with identified subjects, they could allow the identification of users - by their very nature and through processing and association with data held by third parties. For example, these include the IP addresses or the domain names of the computers used by users who connect to the Site, the unique addresses of the resources requested, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the response given by the server, and other parameters related to the operating system and the browser used.

  Purpose of the processing:  to enable safe and proper use of the Site;

  Legal basis for processing:  the legitimate interest of Guru Jobs in the proper functioning of the Site and the security of navigation, regularly balanced with the rights of the data subject (Art. 6, para. 1, lit. f, GDPR [General Data Protection Regulation]).

 

b)  Request for information through dedicated sections 

You can contact us via the contact forms available on the Site or using the contact details indicated on the Site to request information or assistance, including about individual products/services or to obtain technical information and/or information on the products/services offered; this involves the subsequent acquisition of the data you have communicated to us (name, surname, company, email address, telephone, and the information reported in the communication) and, of course, means that you allow us to send you any response communications using the contact details you provided at the time of the request.

The data will be used only to provide you with feedback, unless there is a subsequent activation or request by the user himself for additional services from Guru Jobs.

  Purpose of processing : to ensure adequate support in relation to your needs and to respond to your requests;

  Legal basis for processing : the provision of the service you have requested (Art. 6, para. 1, lit.

b, GDPR).

 

c)  Participation in job selection procedures 

Through the Site, it is possible to view job offers posted by Guru Jobs for its partners and participate in the corresponding selection processes by applying for the position of interest. The data requested through the specific application forms are necessary to identify the candidate, to be able to contact them back, and, of course, to assess if their skills match what is required for the position of interest. Similarly, the personal data included in the Curriculum Vitae attached by the user will be processed solely for the purpose of the selection for which the user is applying. The collected data will be used only for the purpose of the selection. Consent for processing is not required, pursuant to Article 111bis of Legislative Decree No. 196/2003 (known as the Privacy Code, as amended by Legislative Decree No. 101/2018) and Article 9, paragraph 2, letter b) of the GDPR, when the processing concerns data contained in resumes spontaneously transmitted by candidates for the potential establishment of an employment/collaboration relationship, even if it involves data falling within the special categories provided by Article 9 of the GDPR (for example, in cases where such data must be known due to the employment relationship being established, particularly regarding the possible inclusion of the candidate in protected categories or the need to carry out pre-employment medical examinations). The provision of this data is mandatory only for the submission of one's application and therefore it is up to the individual candidate to decide whether to proceed with sending their curriculum vitae: refusal will result in the inability to use the service, without further consequences.

When the user applies for a job offer from a party other than the Data Controller, they acknowledge and accept that the data communicated through the Site must also be communicated to the partner who initiated the offer or another authorized agency, in case the offeror has entrusted a third party to manage the procedure (who in turn may communicate them to the potential employer or their client). In this case, the communication of data is mandatory, as it is essential for the purpose pursued by the user themselves (i.e., applying for a specific job position), which will act in compliance with Article 14 of the Regulation.

The data will be stored for the period necessary to evaluate your request and, in any case, for a maximum period of two years. The deletion of the data sent will also be carried out at any time, in case of a specific request from the candidate to the Data Controller. For the retention of data by the partners to whom the job proposal refers and any request for deletion of data by them, the user must always address the relevant entity/potential employer who acts in this case as an independent data controller.

  Purpose of processing : to provide the service requested by the data subject and to evaluate the application request received for the potential establishment of an employment relationship;

  Legal basis for processing : to execute the contractual relationship of which the data subject is a part – participate in the job selection (Art. 6, para. 1, lit. b GDPR).

 

d)  Completion of the attitudinal questionnaire   

Through the Site, it is possible to use the attitudinal questionnaires and I-Profile System services, which the user can access depending on the purpose pursued and the methods possibly agreed upon with Guru Jobs.

The questions are created based on various elements of evaluating a professional profile (for example, the aptitude for planning and organizing work, the aptitude to work independently, the aptitude to manage finances) and never contain nor involve the use of data falling into the special categories referred to in Article 9 of the GDPR (such as data related to health, ethnic origin, or the user's political opinions).

The data that the user enters in the questionnaire are processed exclusively in an aggregated manner by the Data Controller and processed automatically for predefined categories through a computer system: this means that the individual responses provided by users are in no case known to the Data Controller and/or third parties and are always absolutely confidential. The results of the questionnaire collected by the Data Controller and/or the partner consist of a graphical representation of values resulting from the overall set of responses provided by the candidate, processed through an automated analysis system that determines an indicative profile of the user's professional aptitudes. Furthermore, it is specified that the automated procedure will be carried out in accordance with recital 71 of the GDPR: the profile obtained will always be subject to an analysis by the professionals appointed by Guru Jobs and/or by the job offeror and will not determine any automatic consequences for the user.

When the questionnaire is part of the professional selection procedure for which the user wants to apply, completing it is never mandatory and does not in any way hinder the selection process or the finalization of the application. In fact, the questionnaire is not an alternative to a personal interview with the appointed professionals, but is merely an optional additional option. If the user does not wish to complete the questionnaire, the selection process for which they have applied will still proceed: for this purpose, the user may be contacted, for example, to arrange specific direct interviews.

When the questionnaire is proposed within a selection procedure to which the user has applied for a job offer from a party other than the Data Controller, the results of the questionnaire (always intended as an aggregated profile analyzed by the appointed professionals) may also be communicated to the partner who initiated the offer or another authorized agency, in the case that the offeror has entrusted a third party to manage the procedure (who in turn may communicate them to the potential employer or their client). In this case, the communication of this information is not mandatory: if the user consents, the parties to whom the data will be communicated will act in compliance with Article 14 of the GDPR.

  Purpose of processing:  to evaluate certain attitudinal profiles of the user in relation to a job position of their interest;

  Legal basis for processing:  the user's freely given consent (Art. 6, para. 1, lit. a, GDPR).

 

e)  Completion of the corporate evaluation questionnaire 

Guru Jobs may also provide users with a corporate evaluation questionnaire and/or for individual departments or business sectors, requested by a company to identify any issues and improve its professional environment and the productivity of its staff. In this case, the personal data (registration data and email address) will be provided to Guru directly by the respective employer, to whom you should refer for any appropriate information. The user will receive at the email address provided to Guru by the company an anonymous link to access the questionnaire. No further personal data of the user completing the questionnaire will be requested, and the results will only be visible in aggregate form.

 The same technical guidelines apply to this questionnaire as mentioned in the previous point, in particular: the data entered by the user never contains or involves the use of data falling into the special categories referred to in Article 9 of the GDPR (such as data related to health, ethnic origin, or the user’s political opinions), are processed exclusively in an aggregated manner by the Data Controller and processed automatically for predefined categories through a computer system, and the profile obtained will always be subjected to an analysis by professionals appointed by Guru Jobs and will not determine any automatic consequence for the user. The data is returned to the client solely for information/training purposes in aggregate form and the employer will not be able to view the individual responses provided by the user, but only aggregated score data.

  Purpose of processing : to evaluate the corporate climate to identify necessary improvements based on the considerations of the client's employees/collaborators;

  Legal basis for processing : the user's freely given consent (Art. 6, para. 1, lit. a, GDPR).

 

f)  Registration and access to personal account 

Users can create a personal account by filling out the form on the appropriate pages on the Site, for example as a candidate (https://guru.jobs/login/register )  , as a company – partner or client(https://guru.jobs/hrEmployee/signUp )   or as a user of courses and/or events organized by Guru Jobs(https://gurujobs.academy/my -account/) .  

For candidate users, for registration and access to the restricted area, personal data of the user and/or those identifying them (name and surname, email address, and mobile number) are collected. The password will be chosen and can always be freely changed by the user, adhering to the security characteristics set by the Data Controller (for example, the number and type of characters usable). In the case of companies (partners or clients), the profile will be created by the Data Controller with the data relating to the existing contractual relationship and the functionalities connected thereto; however, each user may then modify their personal information, within the scope of the services they can contractually use.

The personal account will contain information related to the identification and contact data of users, the functionalities used (e.g., completion of questionnaires, applications, etc.) as they use the services. You may optionally provide us with other data possibly requested to improve the service provided by Guru Jobs (for example, preferences on the types of job offers, on the areas or on the themes of the events). Each user may at any time request the deletion of their account and all data stored therein: in this case, some data must still be kept by Guru Jobs for the periods of time required by applicable law.Furthermore, in the event of non-use of the account by the user for a period exceeding six months, all data stored therein and connected to that account will be automatically deleted by the Owner, together with the related personal profile. Before proceeding with the deletion, the Owner will notify the user with a specific communication and the user may always request that the account be kept active and that the related data be stored for the agreed purposes. 

After deleting an account, only the data relating to the registration of the user's subscription and cancellation requests will be kept by the Data Controller, necessary to demonstrate the proper fulfillment by the Data Controller.

  Purpose of processing : to provide an additional service to the data subject by allowing them to use the functionalities and services reserved for holders of a personal account, including the ability to view the history of services, save their preferences, and verify any ongoing procedures;

  Legal basis for processing:  to execute the contractual relationship of which the data subject is a part (Art. 6, para. 1, lit. b GDPR).

 

g)  Course Registration 

By filling out the forms available on the Site, you can request enrollment in courses and/or events organized or promoted by Guru Jobs and its partners. The data provided will be processed by the personnel appointed by the Data Controller exclusively to manage the registration request and the activities before or after the user's participation in the course: you may be contacted, for example, for detailed information about the location and times of the event, for special requests if interventions are planned, or for conducting surveys on satisfaction and evaluation of the event. The courses may also be organized by entities other than the Data Controller, as indicated on the respective descriptive pages: in these cases, the data provided by the user, to the extent and as necessary to enable correct participation in the course, will also be communicated to the course organizer. In case of doubts, we invite you to contact Guru Jobs directly for clarification at info@gurujobs.it.

  Purpose of processing : (i) to manage the registration request and subsequent participation in the course indicated by the data subject and (ii) the analysis of satisfaction and identification of issues and/or improvements in the services provided;

  Legal basis for processing : (i) the provision of the service you have requested (Art. 6, para. 1, lit. b, GDPR) and (ii) the legitimate interest of Guru Jobs in verifying the operation and use of the services made available to users (Art. 6, para. 1, lit. f, GDPR).

 

h)  Requesting and using business or professional consulting services  

Guru Jobs provides specialized professional consulting services in the field of human resources and for the management, research, and selection of collaborators and employees, as well as for training, to improve the approach to the world of work and to increase the chances of success for candidates. Through the Site, it is possible to submit requests to activate customized consulting pathways and/or to use the services and professional systems of Guru Jobs by filling out the forms in the appropriate sections. It always remains the user's prerogative to decide whether to use such services and provide any data necessary for the Data Controller to present quotes and services suited to the user’s needs. Requesting services through the dedicated sections or contacts involves sending by Guru Jobs some communications via email (or telephone in case of emergencies or special requests) to present the service and to provide or receive the necessary information and updates to make the most of the purchased service. At the end of the agreed service or consultation, Guru Jobs may send some communications via email to propose to the user other related services similar to those already used. Personal data will not be used for further purposes unless the user requests the activation of new services or the purchase of products or has given consent for further purposes provided by this policy. Purpose of processing:  to provide specialized consulting services and systems;

 Legal basis for processing : the provision of the service you have requested (Art. 6, para. 1, lit. b, GDPR) and the regulatory provision of Art. 130, para. 4, Legislative Decree 196/2003 which legitimizes the sending of communications concerning products or services similar to those already requested (Art. 6, para. 1, lit. c and f, GDPR).

 

i)  Booking and participating in a demo of Guru Jobs services  

Through the Site, when made available by the Data Controller, it is possible to request to try, for limited periods of time or with limited functionalities, the consulting services or professional systems of Guru Jobs by filling out the forms in the appropriate sections (for example,https://gurujobs.it/book-ademo/)  . The demos are provided free of charge by the Data Controller, but are only available to those who consent to the processing of their contact data to receive promotional communications from Guru Jobs concerning services, products, and events organized or promoted by the Data Controller. For more information on the commercial communications of Guru Jobs, please refer to the subsequent point (n) of this article.

The user can always freely decide to provide such consent to the Data Controller and thus to take advantage of the free trial services, instead of requesting the paid services from the Data Controller. In any case, it is always possible for the user to revoke the consent given and request the cessation of such processing to no longer receive commercial communications. To this end, you can use the specific links provided in each communication received or make a special request to Guru Jobs through the contact details indicated in this policy.

Additionally, to enable the user to use and participate in a demo, Guru Jobs will send some instrumental and functional communications for the service itself, via email or by phone, in case of urgencies or specific requests from the user, with the purpose of presenting the service and providing or receiving the necessary information and updates to make the most of it. At the end of the trial period or at the end of the agreed consultancy, the trial service will be automatically deactivated, and the user will continue to receive commercial communications from Guru Jobs, unless they opt out and request the cessation of processing. For this purpose, you can use the specific links provided in each communication received or make a special request to Guru Jobs through the contact details indicated in this policy.  

  Purpose of processing:  to provide demos and trial periods of the services or products supplied by Guru Jobs to users who agree to receive commercial communications from the Data Controller;

  Legal basis for processing:  the user's expressed, free, and optional consent (Art. 6, para. 1, lit.

a, GDPR).

 

j)  Downloading guides, ebooks, and other materials 

Guru Jobs makes available to users in-depth digital content that can be downloaded for free: however, by requesting the download of such materials, the user agrees to be subscribed to a mailing list dedicated to events and services organized or promoted by the Data Controller and must provide express consent to this processing. The user can always freely decide to provide the Data Controller with the personal data and consent required each time to download the guides, eBooks, and other materials made available through the pop-ups and forms on the Site. It remains always possible for the user to revoke the consent given and request the cessation of such processing to no longer receive commercial communications. To this end, you can use the specific links provided in each communication received or make a special request to Guru Jobs through the contact details indicated in this policy. For more information on the commercial communications of Guru Jobs, please refer to the subsequent point (n) of this article.

In any case, the contents downloaded from the Site represent material owned by the Data Controller for private use and may not be used by users for purposes other than those expressly indicated by Guru Jobs.  

  Purpose of processing:  to make available to the user digital content and send them commercial communications on topics related to the materials for which the user has expressed interest;

  Legal basis for processing:  the user's expressed, free, and optional consent (Art. 6, para. 1, lit.

a, GDPR).

 

k) Work with us  

In addition to using the sections of the Site for applications, you can contact us to submit your application for open positions at Guru Jobs itself by filling out the appropriate form in the "Work with us" section (https://gurujobs.it/lavora -con-guru-jobs/)   and thus authorizing the Data Controller to process personal data for the aforementioned purpose. For this purpose, identifying data (name and surname), a contact email address, a mobile number will be requested, and you must share with us a file with your curriculum vitae, as these are information necessary for Guru Jobs to assess your proposal for collaboration.

The provision of this data is mandatory only for the submission of one's application and therefore it is up to the individual candidate to decide whether to proceed with sending their curriculum vitae: any refusal will result in the inability to use the service, without further consequences.

 Consent to processing is not necessary, pursuant to Article 111bis of Legislative Decree No. 196/2003 (known as the Privacy Code, as amended by Legislative Decree No. 101/2018) and Article 9, paragraph 2, letter b) of the GDPR, when the processing concerns data contained in resumes spontaneously transmitted by candidates for the potential establishment of an employment/collaboration relationship, even if it involves data falling within the special categories provided by Article 9 of the GDPR (for example, in cases where such data must be known due to the employment relationship being established, particularly regarding the possible inclusion of the candidate in protected categories or the need to carry out pre-employment medical examinations). l) Newsletter  

The Guru Jobs newsletter is sent via email to those who explicitly request it by filling out the appropriate form on the Site with their email address and authorizing Guru Jobs to process their personal data for the aforementioned purpose. The service is provided exclusively after the user has given explicit and unequivocal consent (given by selecting the appropriate box on the Site). The provision of data is mandatory only for the purpose of receiving the newsletter and any refusal will result in the inability to use the service, without further consequences.

In any case, to stop receiving the newsletter, it is sufficient to select the unsubscribe link at the end of each email, or to send a specific request to the email addressinfo@gurujobs.it  . The cancellation is managed in a partially automated manner, so further newsletters may arrive for a period following such request, however not beyond 72 hours from the cancellation request, and whose sending was planned before the receipt of the cancellation request.

  Purpose of processing:  to send the data subject email communications relating to services and events organized by Guru Jobs, news and updates on topics related to them;

  Legal basis for processing:  the consent of the data subject (Art. 6, para. 1, lit. a, GDPR).

 

m)  Sending marketing communications within the scope of legitimate interest and soft-spam   In some cases, we may use the email address provided by the user via the Site (for example, in case of participation in an event organized by Guru or a trial of a service in demo) to send some promotional communications, even without asking the user for prior consent. This processing will be carried out in compliance with Article 6, para. f, GDPR and Article 130, para. 4, of Legislative Decree 130/2003. Specifically, users are informed of the processing activity through this policy and are always granted the right to object, in a simple and free manner, to such processing: each communication sent by the Data Controller, in fact, contains a reference to this information and instructions on how to request the cessation of processing (via opt-out), by contacting the Data Controller or by directly selecting the appropriate link provided at the bottom of each communication.

p)  General Statistics 

The Data Controller may use the data of users collected through the Site to perform general statistics: this processing will be carried out exclusively on anonymized or pseudonymized data and in an aggregated form solely for the purpose of improving the quality of the services offered. 8.  Where are the data processed?

The data processed by Guru Jobs are located on servers situated in Europe, provided by the company OVH S.R.L. (Sole Shareholder), VAT 06157670966, and the company SiteGround Spain SL, TAX ID: B87194171.

However, some service providers, such as Google Inc. for certain cookies, are also based in countries outside Europe, particularly in the United States. In these cases, personal data may also be transferred to servers located in the United States: in these instances, compliance with the guarantee measures provided for and required by the adequacy decision adopted by the European Commission on July 10, 2023, relating to personal data transferred from the EU to US companies and their adoption by the relevant provider will always be verified. Guru Jobs will process your personal data for the time reasonably necessary to achieve the purposes previously listed, available in the section "What data will you process?"  or for the retention terms provided by each sector-specific regulation. In any case, at the end of the retention period, your personal data will be deleted or made irreversibly anonymous.

Interested parties can file a complaint when the processing carried out by Guru Jobs Srl does not comply with the provisions of European Regulation No. 679/2016 and national legislation and falls within the cases of violation of their rights, as provided by such legislation.
